Warranty, Software Code Usage Agreement and
Copyright Notification
This is a legal agreement between ("
"), hereinafter referred to as "PURCHASER" (either an individual or an
entity) and Dimension Trader, Inc. of Cincinnati, Ohio, hereafter
referred to as "SUPPLIER".
By using this copyrighted software PURCHASER agrees to be bound by the
terms of this agreement.
This product is provided via download from the ConfluenceZones.com
private user's site. A User ID and password will be required to access
the site. After running the installation file your system will be
enabled with the "SystemAuth" workspace. Once purchased the
product is NOT RETURNABLE.
All updates will be free for a period of one year from the date of this
agreement. After one year, Dimension Trader, Inc. may at it's discretion
charge a nominal annual fee of for any updates after that date.
Whereas: SUPPLIER has produced Easy Language code and certain
application DLL's (hereinafter referred
to as "SOFTWARE" , for use with TradeStation Platform developed by
TradeStation Technologies, Inc."), and
Whereas: PURCHASER has purchased from SUPPLIER said SOFTWARE, Therefore:
SUPPLIER hereby grants a license to PURCHASER to use multiple copies of
the SOFTWARE on up to three of their personal computers; all must use
the SAME Tradestation Customer ID.
Copyright: The SOFTWARE written by SUPPLIER is protected by United
States copyright laws and international treaty provisions. PURCHASER
agrees to treat the SOFTWARE like any other copyrighted material, such
as a book or musical recording. PURCHASERS agrees not to copy,
duplicate, sell, reverse engineer or otherwise distribute the SOFTWARE
code, except that PURCHASER may either (a) make one copy of the SOFTWARE
solely for backup or archival purposes, or (b) transfer the SOFTWARE to
a single hard disk provided PURCHASER keeps the original solely for
backup or archival purposes. PURCHASER agrees not to let any other
person review or visually inspect the software code now or in the
future.
Other Restrictions:
PURCHASER may NOT transfer the SOFTWARE to anyone else. If the PURCHASER
does wish to transfer ownership the PURCHASER must contact Dimension
Trader, Inc. at 513.277.0305 and request the transfer. A bill of sale to
the new user MUST be provided. The Transfer Fee will be 40% of the
current price of the software. The original PURCHASER will also agree to
NOT retain any copies of the programs or manuals and agrees to delete
all installed copies.
Limited Warranty: SUPPLIER warrants that (a) the SOFTWARE will perform
substantially in accordance with written materials and information on
our web site. By signing this agreement or purchasing the software
PURCHASER acknowledges that the software code is for educational
purposes only, and that Dimension Trader, Inc. does not promise profits
by using the SOFTWARE code. Further, no recommendation is being made to buy
or sell stock, mutual funds or futures interests. PURCHASER further
acknowledges that trading involves risk and that there are no guarantees
of profit from trading; rather, there is a substantial risk of monetary
and /or emotional loss. The acceptance of this license may be by either
signature of this document, acceptance of unlock codes or purchase of
the software from Dimension Trader, Inc.
